Cal LabPro
These terms are an agreement between you and Cal LabPro Pty Ltd ("we", "us") for using the Cal LabPro app ("the app"). By creating an account or using the app, you agree to them. Please also read our Privacy Policy.
1. Not medical advice
Cal LabPro is a general wellness tool for tracking food and weight. It is not medical advice, and it doesn't diagnose, treat or prevent any condition. Calorie and nutrition figures, including AI estimates, are approximate and can be wrong. Talk to a doctor or dietitian before you make big changes to your diet or weight, especially if you are pregnant, have a medical condition, or have, or have had, an eating disorder.
2. Who can use the app
You must be at least 16 years old. You're responsible for keeping your password safe and for what happens in your account. The information you give us should be accurate.
3. The free plan and Premium
- The free plan includes a limited number of AI plate scans each day (currently 3). We may change free plan features and limits.
- Cal LabPro Premium is a subscription bought through the App Store (Apple) or Google Play, which take the payment. The prices and plans are shown in the app before you buy.
- Subscriptions renew automatically at the end of each period (monthly or yearly) unless you cancel at least 24 hours before it ends. You can cancel at any time in your App Store or Google Play account settings. Deleting the app or your account does not cancel a subscription.
- Free trials: if a free trial is offered, it turns into a paid subscription when it ends unless you cancel before then.
- Refunds are handled by Apple or Google under their refund policies. Nothing in these terms limits your rights under the Australian Consumer Law.
- If we change the price of a subscription, you will be told in advance and can cancel before the new price applies.
4. Invite rewards
When a friend joins with your invite code, you and your friend can earn free Premium time as described in the app. Rewards are free Premium days, not cash, and can't be exchanged or transferred. You may only invite real people, who choose to join themselves; creating fake accounts or abusing the programme can lead to lost rewards or a closed account. We may change or end the invite programme at any time, but we will keep rewards that have already been earned.
5. Using the app fairly
Please don't misuse the app. In particular, don't:
- break the law, or use another person's account without their permission;
- upload photos of other people, or anything offensive or illegal;
- try to get around the daily scan limit, reverse engineer, overload or attack the app or its servers;
- use automated tools to access the app, or resell it.
6. Your content
You own what you add to the app, such as your diary, photos and weights. You give us permission to store and process it only so that we can run the app for you, including sending meal photos to our AI provider for analysis. You can delete your content and your account at any time.
7. Our app
The app, its design, its name and its logo belong to Cal LabPro Pty Ltd. We give you a personal, non-transferable licence to use the app on your own devices for as long as you follow these terms. Nutrition data for packaged foods comes from Open Food Facts, which is available under the Open Database Licence.
8. Changes and availability
We work hard to keep the app running and accurate, but we can't promise it will always be available, error-free or uninterrupted. We may update, change or remove features. If we make important changes to these terms, we will tell you in the app or by email before they apply. If you don't agree, you can stop using the app and delete your account.
9. Your rights under the Australian Consumer Law
Our services come with guarantees that can't be excluded under the Australian Consumer Law, and nothing in these terms takes them away. Where the law allows us to limit our liability for a failure to meet a guarantee, our liability is limited to supplying the service again, or paying the cost of having it supplied again.
10. Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by relying on calorie or nutrition estimates, by things outside our reasonable control, or by your use of the app against these terms. To the extent the law allows, our total liability to you is limited to the amount you paid us for Premium in the 12 months before the claim.
11. Ending your use
You can stop using the app and delete your account at any time (Profile, then Delete account). We may suspend or close an account that seriously or repeatedly breaks these terms. Where it's reasonable, we will warn you first.
12. Governing law
These terms are governed by the laws of Queensland, Australia, and you and we agree to the non-exclusive jurisdiction of the courts of Queensland. If you live in another country, you also keep any consumer protection rights that the law where you live gives you.
